1st Bar Council of India International Law Moot Competition was a Grand Success


The Bar Council of India Trust has been organising national level Moot Court Competitions for about 26 years. The Bar Council of India, an apex body for the entire legal profession, decided to give it an international dimension from this year and selected KIlT to conduct the 1st BCI International Moot Court Competition. It is an attempt to foster interest in the area of International Arbitration. It will be an annual event, garnering participation not only from institutions across India, but internationally as well.

 

Inaugurating the competition, Hon'ble Mr. Justice B. P. Das, Judge, Odisha High Court lauded the initiative of Bar Council of India Trust and KIlT School of Law for organizing a moot court competition at international level. It is a unique opportunity for the students, he said in his. Inaugural address, while hoping that it will immensely benefit the participants. In the same vein, Mr. Ashok Mohanty, Advocate General, Odisha termed it a historical development. Moot court helps develop skills of a professional advocate, he said. Area of litigation has expanded manifold with the opening up of economy, he told the participants, while stating that people look upon lawyers to resolve the litigations.

 

Speaking on the occasion, Mr. Jagannath Patnaik, Former Chairman, Bar Council of India said that law should address present day economic and social challenges. Mr. Ashok Parija, Member, BCI and Convener of the competition introduced the concept and outlined benefits of moot court competition.

 

Winners of the competition were awarded at the valedictory ceremony, which was graced by Hon'ble Mr. Justice Altamas Kabir, Judge, Supreme Court of Indio, Hon'ble Mr. Justice, A. K. Patnaik, Judge, Supreme Court of Indio, Hon'ble Mr. Justice B. P. Das, Judge, Odisha High Court, Mr. Gopal Subramanium, Solicitor General of India & Chairman, BCI and other legal luminaries.

 

Mooting must also address impacting mind of the judge, said Hon'ble Mr. Justice, A. K. Patnaik, Judge, Supreme Court of Indio, while reminding the budding lawyers that judge is also a human being. Mr. Gopal Subramanium pointed out that protecting rights of people who do not afford legal expenses is an important role of legal professionals.

 

A good advocate has respect for human values, said Hon'ble Mr Justice B. P. Das, Judge, Odisha High Court, while adding that moot competition will make students proficient in art of court craft. Stressing on the importance of skill in law, Prof. N. L. Mitra, Former VC, NLU Jodhpur & Chief Advisor, KIlT School of Law, said moot court, a dialectic process of learning, is superior to conventional classroom teaching.

 

Mr. Ashok Kumar Deb, Managing Trustee, BCI Trust expressed satisfaction on the grand success of the competition. Mr. Ashok Parija, Convener of the competition and Member, BCI placed report of the competition.

 

The opportunity to organize this prestigious event in KIlT is a matter of pride not only for the university, but for the State of Odisha as a whole, said Dr. A. Samanta, Founder, KIlT & KISS. He expressed his gratitude to the legal luminaries for their gracious presence. Dr. Samanta thanked BCI and BCI Trust for selecting KIlT School of Law for this prestigious event.

 

Shri Vijay Bhatt, Trustee, Shri D. R. Sharma, Associated Trustee, BCI Trust and Prof. A. S. Kolaskar, Vice Chancellor, KIlT University also spoke on the occasion. Prof. N. K. Chakrabarti, Director, KIlT School of Law proposed the vote of thanks.

Only 71 Per Cent Candidates Passed the First All India Bar Exam (AIBE), 2011

 Only around 71 per cent of candidates in the first All India Bar Exam (AIBE) result which is declared today,are declared qualified, where the final grading for pass marks was a flat 40% according to a Bar Council of India (BCI) press release, which would mean roughly 6,300 graduates enrolled for the exam would have to retake it including Chennai graduates.
Despite opposition and court cases against it, the first-ever All India Bar Exam (AIBE) was successfully conducted on Sunday, 6th March, 2011 across 45 examination centres. The object of the exam was to  assess capabilities at a basic level, and is intended to set a minimum standard for admission to the practice of law; it addresses a candidate’s analytical abilities and basic knowledge of law. The notification bringing the All India Bar Examination into force was passed by the Legal Education Committee and the members of the Bar Council of India at duly constituted meetings on April 10, 2010 and April 30, 2010.Except for three centres in Chennai, which saw lawyers staging protests. The exam, saw 98 per cent turnout. It went off extremely well, except for some trouble in Chennai, where pproximately 1,600 candidates did not manage to take the exam. For them it will now be held on March 27. It is a great step towards the reform of legal education in India.
 The pass percentage amongst male and female candidates is nearly the same and “Candidates who were unable to pass the AIBE, they will be allowed to take the next AIBE . The release did not state how many candidates not counted in the 71 per cent pass rate did not pass due to non-attendance or failing to achieve the correct score.
The results can be seen from the BCI website, www.barcouncilofindia.org . The same is also available at the state Bar Councils of different states.
Low pass percentage in a very elementary paper reflects the actual standard of the legal education in India.Now  it is quite clear that there is some problem somewhere in the model of legal education. The result reflects that 29% fresh law graduates are below minimum standard. Now we have to think seriously and refine the whole system so the same thing may not be repeated in future.
